These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Baripada Town P.S. Case No. 356 of 2026 arising out of C.T. Case No. 627 of 2026 pending in the Court of learned SDJM, Baripada, for commission of offence punishable U/Ss. 331(4)/ 305 of BNS, on the allegation of committing theft in the house of the informant by taking away one Sony camera, key of bullet and cash of Rs.5,000/-.
Heard, Mr. Anjan Kumar Biswal, learned counsel for the petitioner in BLAPL No. 6268 of 2026, Mr. Arijeet Mishra, learned counsel for the petitioners in BLAPL No. 6900 & 6931 of 2026 and Mr. M.R. Patra, learned Addl. PP in these matters and perused the record.
After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 27.05.2026 with submission of charge sheet in the meantime and taking into account the other circumstances on record in entirety including the inherent right of the accused-petitioners to be presumed innocent until proven guilty at the trial and the offences alleged against the petitioners being triable by Magistrate and the law laid down by the Apex Court in Satender Kumar Antil Vrs. Central Bureau of Investigation; (2022) 10 SCC 51, this Court without expressing any view on merit, admits each of the petitioners to bail.
Hence, these three bail applications of the petitioners namely Sk. Tasip (BLAPL No. 6268 of 2026); Akash @ Badal Mukhi (BLAPL No. 6900 of 2026) and Anubhab Behera (BLAPL No. 6931 of 2026) stand allowed and each of the petitioners are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
