Mr. J. Kamila, learned counsel for the petitioner prays an adjournment stating that since chargesheet has not been filed as yet the case may be adjourned so that in the meanwhile the chargesheet may be submitted.
This application under Section 439 of Cr.P.C. has been filed in connection with Madhupatna P.S. Case No.414 of 2023 corresponding to Special G.R. Case No.35 of 2023, pending in the file of the learned Sessions Judge-cum-Special Judge, Cuttack, registered for commission of offences punishable under Section 21(b) of the NDPS Act against the petitioner and the co-accused, Ajid Hossen.
The prayer for bail of the petitioner and co-accused, Ajid Hossen had been rejected on 09.01.2024 by the learned. Sessions Judge-cum-Special Judge, Cuttack.
BLAPL No. 441 of 2024 filed by co-accused, Ajid Hossen has been dismissed on 01.02.2024 granting liberty to the petitioner therein to move for bail afresh after completion of investigation.
As investigation is in progress in the case and BLAPL No. 441 of 2024 filed by co-accused, Ajid Hossen against whom similar allegations have been made has been dismissed granting him liberty to move for bail afresh after completion of investigation, I am not inclined to entertain this prayer for bail at this stage.
The BLAPL is accordingly dismissed.
It is open for the petitioner to move for bail afresh after completion of investigation.
Urgent certified copy of this order be granted on proper application.
