Judgment
M.N. Gilani, J.—This court vide order dated 26th March 2012 released the applicant accused on interim bail. It was mainly on the ground that, the charge sheet which was filed by the prosecution was not accompanied with the report of the Chemical Analyser. Heard both sides. Perused reply filed by the prosecution. The incident occurred on 3.6.2011 near Lahoti College, Amravati. One vehicle was intercepted and in that ganja weighed 102 k.g. was found being carried. Two inmates of the car fled away. On 29.6.2011, the applicant-accused came to be arrested mainly on the basis of the mobile call details. Only evidence against accused appears to be that he was in contact with the other accused persons by using the mobile. Thus, this is a case where reasonable ground exists to believe that the accused has not committed an offence punishable under the Act. In that light of the matter interim bail granted by this court on 26.3.2012 is confirmed.
Application stands disposed of. Hamdast granted.
