Heard Ld. Advocate for the Applicant.
Prayer in this Application is to correct / modify part of the order dated 29.01.2021 by which the Applicant was permitted to make Application for adjudication of stamp duty. However, the same order reflects that the Applicant is permitted to make “payment of stamps” within the period of 210 days. In view of the above direction in the order directing the Applicant for payment of stamp duty within 210 days which in any event cannot be paid in the absence of adjudication by Stamp Authorities; which on the date of passing of this order was still pending and indicates that the adjudication was completed on 22.06.2021.
Having regard to the above case of the Applicant and for the grounds mentioned in the Application in para 9 and 10 of the Application, we find it necessary to modify order dated 29.01.2021 to the limited extent by substituting words “payment of stamp duty” with words “Application for adjudication of stamp duty”. Necessary modification as aforesaid be carried out in the last but one line in para 3 of the order dated 29.01.2021. Necessary modification be made in the original order and the order uploaded on the website. Rest of the order shall stand unchanged. Application bearing CA 175 of 2021 is disposed of as allowed in above terms.
