The petitioners are included in the rank list for appointment to the post of Assistant in the first respondent University. The rank list came into force on 6.7.2010 and is expiring on 5.7.2012. The petitioner is serial No. 341 in the rank list. He is a Scheduled Caste. The petitioner is seeking for a direction to consider his claim for appointment in terms of the existence of 132 substantive vacancies. Learned Standing Counsel for the University submitted that the number of temporary vacancies of Assistants existing as on date is 17 and out of this, four officers are expected to rejoin on 2.4.2012. It is submitted that depending upon the number of vacancies, the turn of the petitioner for appointment will be 5th.

While filling up of the vacancies, steps will be taken to appoint candidates in terms of the ranking in the rank list and the turn of the community. The same will be done taking note of the fact that the rank list will be expiring on 5.7.2012 and the appointment will be made before the expiry of the rank list.

The writ petition is disposed of as above. No costs.
