Judgment

The petitioner, which is a College of Nursing, impugns Ext.P7, whereby, their intake of students for the B.Sc Nursing Programme being conducted by them, has been reduced from 90 to 46. The petitioner asserts that Ext.P7 is egregiously improper and therefore, that it is liable to be set aside.
Sri.P.Sreekumar – learned Standing Counsel for the Kerala University of Health Sciences (KUHS), responded to the afore submissions of Sri.V.Jayapradeep – learned counsel for the petitioner, saying that Ext.P6 is the result of an enquiry and inspection conducted by his client, wherein, it was found that sufficient number of in-patients were not available in the parent hospital attached to the College. He, however, submitted that, consequent to the directions of this Court pending this lis, a further inspection was conducted and it has now been found that the College is entitled to an intake of nearly 80 seats, under the Nursing Stream. He submitted that scrutiny in this regard is being carried on by the University and that a fresh order, substituting Ext.P7, will be issued without any further delay.
Sri.V.Jayapradeep – learned counsel for the petitioner, at this time, intervened to say that admissions to the Course will have to be completed by 30.09.2022.
Taking note of the afore submissions, I order this writ petition and direct the KUHS to complete the proceedings relating to the student intake of the petitioner; and issue a fresh order, withdrawing Ext.P7, as expeditiously as is possible, but not later than two weeks from the date of receipt of a copy of this judgment.
Needless to say, subject to the right of the petitioner against the order to be issued by the University, they will be at liberty to complete the admissions, as per the intake to be granted to them.
