Judgment
B.P.Nos.516, 519, 520, 521, 522, 523 and 524 are proceeding ex-parte against all the Respondents. Draft Issues have been filed on behalf of both the parties in B.P.Nos.517, 518 and 525 of 2021. Heard the parties and perused the record of the case and in the light of the material available on record of the respective cases, the following Issues are settled:
ISSUES
Whether the Respondents have breached the terms of Model Interconnect Agreement signed with the Petitioner and / or has violated the TRAI Regulations ?
Whether the Petitioner is entitled for recovery of STBs and viewing cards from the Respondents in good working condition or in the alternative the cost thereof ?
Whether the Petitioner is entitled to interest @ 15% on the above amount from the date it became due and payable till its actual realization ?
To what other relief / reliefs the Petitioner is entitled to ?
Six weeks time is prayed and allowed to the Petitioner for filing their Evidence Affidavits in all the matters. The Respondents may file their Evidence Affidavits within six weeks thereafter. Let the matter be listed on 18th July, 2022 for directions.
