Proposed Issues have been filed on behalf of the parties which are available on record of the case. Heard the learned counsels appearing on behalf of the parties and perused the record of the case and, in the light of the material available on record of the case, the following Issues are settled:

Whether the instant petition is maintainable in its present form ?
Whether the parties have breached the terms of the agreement executed between them and / or have violated the terms of the Model Interconnect Agreement or the TRAI Regulations ?
Whether the Petitioner is entitled to a decree for recovery of any outstanding dues in the light of the fact pleaded by them regarding a credit balance with them?
Whether the Petitioner is entitled to a decree for recovery of STBs and viewing cards as per their pleading in good working condition or in the alternative for recovery of the cost of such STBs and viewing cards from the Respondents ?
Whether the Petitioner is entitled to interest on the above amount, if any, and, if yes, at what rate ?
To what other relief / reliefs the Petitioner is entitled to ?
Four weeks time is prayed and allowed to the Petitioner for filing their evidence affidavits. The Respondents may file their evidence affidavits within four weeks thereafter. Let the matter be listed for directions on 27th January, 2023.
