Judgment
Barkat Ali Zaidi, J.—Accusedapplicants Sita Ram and Lalji along with one Ramjee Saroj and Menaj are charged under sections 304, 323, 504 Indian Penal Code. They have come for bail here.
Heard Sri Ali Hasan, Advocate for the applicants and Addl. Government Advocate for the State.
Four persons are said to have assaulted the deceased aged 60 year in village Bhikri Police Station Suriyawan, District Bhadhohi, around 10 A.M. on 9.9.2008. The postmortem report mentions that death of deceased was caused due to lacerated wound on the head. The First Information Report mentions that the injury was caused with a lathi by coaccused Manoj. The applicant was not, therefore, responsible for the fatal injury. On similar consideration, the coaccused Ramji Saroj was granted bail by Hon''ble (Mrs.) Justice Saroj Bala by order dated 4.11.2008. The accused applicant may, therefore, be granted bail.
He be released on bail on his furnishing a personal bond of Rs. Twenty thousand with two sureties in the like amount to the satisfaction of the Trial Court.
