Judgment
Alok Singh, J.—This is an application seeking regular bail in case FIR No. 130, dated 20.07.2010, under Sections 307/323/34 IPC, registered at Police Station Phillaur, District Jalandhar.
Learned Counsel for the Petitioner has vehemently argued that there is a dispute about partition of the properties and vacation of Kothi in question, hence, Petitioner has been falsely implicated by his daughter-in-law / complainant saying that Petitioner (father-in-law) and Daljit Singh - brother-in-law came to the Kothi and father-in-law caught hold her arms and raised lalkara that since complainant party is not leaving the Kothi, hence, she should not be spared on which brother-in-law - Daljit Singh tried to strangulate her. Learned Counsel has further argued that Petitioner has been falsely implicated in the present case and he is in judicial custody w.e.f. 03.01.2011.
Considering the totality of the facts and circumstances of the case, present petition is allowed. The Petitioner is directed to be released on bail to the satisfaction of the learned Trial Court.
