O R D E R
Shri Akhilesh Kumar Singh as brief holder of Shri Ajay Rajendra, counsel for the applicant is present.
Shri Manoj Kumar Sharma, counsel for the respondents is present.
It is submitted by Shri Akhilesh Kumar Singh, Advocate that he has been authorized by Shri Ajay Rajendra, counsel for the applicant to argue the case on his behalf.
Therefore, arguments of both the parties are heard.
It appears from the pleadings that the applicant did not pass the examination in the year 1998. He passed the said examination in the year 2002 and he is claiming the seniority since 1998.
The Division Bench of this Tribunal passed the Order on 01.11.2018 in O.A. No. 1205/2009 Shree Prakash v. Union of India and others and another Division Bench of this Tribunal passed the Order on 24.08.2023 in O.A. No. 1061/2009 Bachcha Jha v. Union of India and others. After perusal of both the aforesaid Orders, it appears that the same question was involved in the aforesaid both OAs and the Tribunal came to the conclusion that the O.A. is not tenable and both the OAs were dismissed.
The present O.A. is also similar to the aforesaid two OAs, therefore, no substance is found in the present O.A. Accordingly, O.A. No. 1582/2009 is dismissed.
