Heard learned counsel for the parties.
In course of hearing, the attention of the Court is drawn to an additional affidavit dated 11.02.2022 filed by the respondents/Union of India, in reply to the additional affidavit filed by the petitioner dated 28.02.2020, wherein at Annexure-A of the same, a communication was found in which the Under Secretary to the Government of India had addressed a letter dated 8th March, 2021 to the Director, Botanical Survey of India, Kolkata as regard a proposal for revoking of the ban on compassionate appointments in BSI.
Mr. R. Debnath, learned CGC prays that he may be allowed to seek instructions as to how the matter has progressed in the department as far as the issue of revoking of the ban on compassionate appointments is concerned.
Mr. R. Jha, learned counsel for the petitioner has also submitted that a decision in this matter as regard the revoking of the ban on compassionate appointments would have a bearing on the case of the parties herein.
This being the case, the learned CGC is directed to seek necessary instructions and if any notification is forthcoming in this regard, the same is to be produced before this Court and filed by way of an affidavit.
As prayed for, list this matter after 4(four) weeks.
