Judgment
Counsel for the Suspended Board of Directors is present. Counsel for the Operational Creditor is present. Counsel for the Suspended Board of Directors submits that through the present application he is seeking closure of the CIR Process against the Corporate Debtor under Section 12A of the IBC 2016. It is seen that the present application has been moved on behalf of the Suspended Board of Directors, instead of IRP. The Counsel submits that in the present case IRP, Mr. Naveen Kumar is not co-operative in the process of filing of the present application. Therefore, he has made the said IRP as Respondent to the present application as well.
After going through the present application as well as during the submissions made by the Counsel for Suspended Board of Directors, we order issuance of notice to the said IRP by the Counsel for Suspended Board of Directors in one week's time.
List the matter before the Regular Bench on 05.07.2022.
