Judgment
As per the ROC report, the petitioner has not filed the balance sheet and annual return for the period 01.01.2021 to 28.11.2021 as per MCA-21. Now the affidavit has been filed vide diary No.01096/8 dated 08.05.2024. The said balance sheet and annual return has been filed late, for which the penalty/late fees etc. are prescribed as per the Companies Act, 2013 and petitioner would be liable for the same. The petitioner is directed to file no dues certificate from the RoC. A copy of this order may also be sent to RoC for filing the report if, there is any pending dues/penalty against the petitioner Company.
The IBBI Report is not on record.
Learned counsel for the petitioner is also directed to inform the next date of hearing to the IBBI/RoC through email and place that copy of email with affidavit on record so that effective proceedings can take place against the respondent on the next date of hearing. If served, then IBBI is directed to file the report within two weeks after service of the email notice. Let the matter be listed on 08.10.2024.
