Judgment
R.N. Laddha, J
Issue notice to the Respondent. Mr. S.G. Bhobe, learned Public Prosecutor, waives notice on behalf of the Respondents and seeks time to file reply. Respondents to file reply on or before 09.06.2022. The Applicant is apprehending arrest in Crime No.250/2020 registered at Mapusa Police Station for the offences punishable under Sections 419, 420, 465, 466, 467, 468, 471 and 472 of IPC.
Learned Counsel for the Applicant submits that till final hearing of the application, interim protection be granted to the Applicant from arrest. It is submitted that the Applicant, in the present case, is himself victim and is prosecuted only on suspicious ground. The nature of the dispute is of civil nature and bypassing the remedy under civil law, the complainant has set the criminal law into motion. It is further submitted that the Applicant had already made complaint to the Police against the complainant on 10.11.2020.
Mr. Bhobe, the learned Public Prosecutor states that the Applicant had applied for anticipatory bail before the Sessions Court, but his application was dismissed. The Sessions Court found that the Respondent/Investigating Agency had placed sufficient material on record to indicate that custodial interrogation of the Applicant was necessary. Further, criminal antecedents of the Applicant is evident from the order of the Sessions Court. Further he submits that already a lookout notice is issued against the Applicant.
In the facts and circumstances, at this stage, I am not inclined to grant interim protection from arrest to the Applicant.
