Rule. Ms. Krina Calla, learned APP waives service of Rule for the respondent State.
the applicant has sought parole leave for a period of 30 days to enable him to attend his daughter's marriage for which different functions are scheduled between 27.10.2020 to 31.10.2020. The applicant is convicted for the offence punishable under Sections 302, 303, 304, 305, 307 and 311 of IPC. His appeal is pending before this Court.
Considering the averments made in the application as well as considering the cause on which the applicant sought parole leave, I am inclined to grant parole leave for a limited period, however, on strict conditions.
Under the circumstances, application is partly allowed. The applicant - convict is ordered to be released on parole leave with Police Japta at the cost of State for a period of 2 (two) days i.e. 30.10.2020 and 31.10.2020 on furnishing a personal bond in the sum of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the concerned jail authority. On expiry of the aforesaid period, the applicant shall surrender before the concerned jail authority on 01.11.2020. Rule is made absolute to the aforesaid extent. Copy of this order be sent to the concerned jail authority forthwith.
