Judgment

Mr. Mohapatra, learned advocate appears on behalf of petitioner. He submits, his client, after having obtained disability certificate certifying suffering 75% blindness, has become completely blind. He is entitled to reservation as such, in applying for job with, inter alia, South Eastern Railway. The selection process was to be concluded today but has just been extended for another 15 days. His client made representation dated 21st December, 2022 to the Chief District Medical Officer, Ganjam, Odisha to examine his grievance of 75% blindness being the same as 80%, for certification of complete blindness.
Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and submits, in event there is direction, petitioner’s eye sight can be examined and certificate issued well within extended date of selection to be made by South Eastern Railway. The certificate will be issued depending upon the test and in compliance with the guidelines.
Petitioner appears to have made out an argument in his representation dated 21st December, 2022 on his degree of blindness being 75% and, therefore, almost 80%, fit to be certified as complete blindness. Such a certificate will get him better reservation on application to get job with Central/State Government/Public Enterprise. Since, the selection process of South Eastern Railway was to be concluded today, Mr. Mohapatra, upon having mentioned in the morning, has moved the petition on urgent basis.
Petitioner has a valid disability certificate, which he can use to apply for job. However, if he wants his eyes to be examined, he may approach opposite party no.3 with this order, obtained from the official website. In event such approach is made, said opposite party is directed to forthwith cause petitioner’s eyes to be examined and issue the certificate based on the examination and in accordance with the guidelines. It is made clear, for petitioner to want expeditious issuance of fresh disability certificate on his eye sight to approach must be made by 13th March, 2023.
The writ petition is disposed of.
