Mr. Sarangi, learned advocate appears on behalf of petitioner and submits, his client made representation dated 12th December, 2022 to the Director of Estates, General Administration and Public Grievance Department. By the representation, he sought settlement of land under Odisha Government Land Settlement Act, 1962. He submits, there be direction upon opposite party no.2 to consider the representation.

Mr. Rout, learned advocate, Additional Standing Counsel appears on behalf of State and submits, petitioner preferred appeal and it is pending, against eviction order passed by the Commissioner-cum-Secretary to Government in Housing and Urban Development Department. By his earlier writ petition in W.P.(C) no.8113 of 2018 he obtained restraint order, preventing coercive action against him. Now he has again moved this Court purportedly pursuant to making the representation to a different department.

It is clear that petitioner is claiming the land he is in occupation of. As such he is facing of eviction and appeal is pending. In the meantime, to further his claim he has made the representation.

Opposite party no.2 is directed to consider said representation dated 12th December, 2022 and deal with it in accordance with law. Result of the consideration should be made known to petitioner within three weeks of communication.

The writ petition is disposed of.
