Judgment

Smt. Shyamo and others have filed this revision against the order dated 26101995 passed by learned Additional Commissioner, Meerut Division, Meerut.
Heard the learned Counsel for the parties and gone through the records carefully.
The learned trial Court in his order dated 16595 stayed the deliverery of possession to the allottees on the ground that before allotment could take place, no list of eligible persons in Form 57Kha was prepared. With this conclusion the learned trial Court arrived at the conclusion on the basis of tehsil report which was on record. Merely by staying the delivery of possession the revisionists cannot claim to be an aggrieved persons. This will amount to be a part of enquiry whether the allotment which has been challenged is according to the relevant provisions of the Rules and Act or not. The conclusion of the learned Additional Commissioner that the revision is against an interlacutory order is perfectly ustified.
With this conclusion the revision is not fit for admission and is accordingly dismissed summarily.
Revision dismissed.
