Judgment
Dinesh Mehta, J
The present bail application under Section 439 of Cr.P.C. has been filed by the applicant seeking regular bail in connection with the FIR No. 151/2023 registered at Police Station Pratap Nagar, Jodhpur City (West) for the offence under Section 379 of Indian Penal Code, 1860.
Learned counsel for the applicant argued that the offence alleged against the applicant is triable by Magistrate. While submitting that neither any investigation nor any recovery remains to be made from the present applicant, learned counsel prayed that the applicant be enlarged on bail.
Learned Public Prosecutor opposed the bail application by contending that 22 cases of like nature have been registered against the applicant in different police stations.
Heard learned counsel for the parties and perused the record.
In the opinion of this Court, if the accused like the applicant is granted benefit of bail, he would indulge in similar nature of offences, as he is a habitual offender. He would pose not only risk for property of the citizens but would also disturb the peace and harmony in the society. Hence, this Court is not inclined to grant bail to the present applicant.
The present bail application is, therefore, rejected.
