Judgment

Petitioners are accused Nos 1 to 4 in Crime No.159/2023 of Payyoli Police Station, Kozhikode registered for offences punishable under Sections 143, 147,148, 341,354,323 and 326 r/w 149 of the Indian Penal Code.
The crime is registered on the allegation that at about 9:00 PM on 29.03.2023, while the de facto complainant and family were their on the way to attend a temple festival, 1st accused wrongfully restrained the de facto complainant and pulled her down by holding her hair and thereby, outraged her modesty. On hearing the hue and cry, the husband of the de facto complainant rushed to her rescue. Thereupon, the accused attacked him, during the course of which husband suffered a nasal bone fracture. The petitioners were arrested and are in custody from 03.06.2023 onwards.
Heard, learned Counsel for the petitioners and learned Public Prosecutor.
Considering the nature of allegations, the fact that the petitioners are in custody from 03.06.2023 and no criminal antecedents reported against them, I am inclined to grant bail to the petitioner subject to the following conditions;
(i) The petitioners shall be enlarged on bail on each of them executing bond for Rs.50,000/- with two solvent sureties each for the like amount to the satisfaction of the jurisdictional court.
(ii) The petitioners shall appear before the investigating officer every alternative Saturday, between 10:00 AM and 11:00 AM.
(iii) The petitioners shall not influence or intimidate the de facto complainant or other witnesses in any manner whatsoever.
(iv)The petitioners shall not get involved in any offence while on bail.
