Heard learned counsel for the petitioner and learned A.G.A. for the State.

The petitioner by way of this petition has made prayer for issuance of a direction to the opposite parties to ensure fair investigation in Case Crime/F.I.R. No.0252 of 2021 under Sections 328, 304, 120-B IP.C., registered at Police Station Sangrampur, District Amethi.

Learned counsel for the petitioner submits that the occurrence took place on 20.04.2021 whereby the matter was investigated into and the investigation is underway but the same is not proceeding smoothly, fairly and transparently and because of that the accused side is bent on threatening and is actually threatening the petitioner to withdraw the proceedings, else severe consequences would follow.

We have heard the learned counsel for the parties and perused the impugned F.I.R. as well as other material brought on record,

Having regard to the above, without expressing any opinion on the merits, this writ petition is disposed of granting liberty to the petitioner to move an application before respondent no.2, Superintendent of Police, Amethi, within two weeks, with the same prayer which has been made by him in this writ petition.

In case any such application is filed by the petitioner before the respondent no.2 along with a certified copy of this order within the time stipulated herein above, the said respondent shall decide the same in accordance with law ensuring fair investigation in the aforesaid F.I.R./crime number by a speaking and reasoned order.
