Judgment
This petition is directed against order dated 28.09.2010 passed by the learned Single Judge of the Punjab and Haryana High Court, who dismissed the Civil Revision filed by the Petitioner against judgment dated 27.08.2003 of Appellate Authority, Bhiwani which had confirmed the order of eviction passed by Rent Controller, Bhiwani on 14.12.1999.
The Petitioner has also filed an application for condo nation of 125 days' delay in filing the special leave petition.
We have heard learned Counsel for the Petitioner and perused the record.
In our view, the explanation given by the Petitioner for delayed filing of the SLP is wholly unsatisfactory and there is no justification for exercise of power by this Court u/s 5 of the Limitation Act.
Even on merits, we are satisfied that the order passed by the Rent Controller was based on correct evaluation of the factual matrix and legal position and the Appellate Authority and the High Court did not commit any error by refusing to interfere with the same.
The SLP is accordingly dismissed on the ground of delay and also on merits.
