Judgment
Petitioner has filed this bail application under Section 439 of Cr.P.C.
NCB Case No.VIII(IO)13/NCB/JZU/2019 for offence under Sections 8, 15, 25 AND 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
It is contended by counsel for the petitioner that the petitioner has been made an accused on the basis of interrogation of co-accused.
Counsel for Narcotic Drugs Bureau has opposed the bail application. It is contended that the recovered contraband is more than commercial quantity. On the same day when the seizure was made, it is revealed that the contraband was supplied by the petitioner. Petitioner had also provided mobiles to the truck driver to keep a track on the contraband. It is also contended that petitioner in his statement has also admitted that he had supplied the contraband.
I have considered the contentions.
Since the matter pertains to commercial quantity, at this stage it cannot be said that the petitioner is innocent and would not repeat the offence after granting bail.
Criminal Misc. Bail Application is accordingly dismissed.
