This is first application filed under Section 438 of Cr. P.C. for grant of anticipatory bail. Applicant -ÂÂ" Smt. Shweta Nagru is apprehending her arrest in connection with Crime No.813/2021 registered at Police Station Lasudiya, District Indore for the offence punishable under Sections 306 and 34 of IPC.

As per prosecution story, deceased, who was staying in the house of applicant had committed suicide leaving a suicide note behind that applicant is responsible for his suicide. The case of the prosecution is that deceased had taken a loan from the husband of applicant, which was not being returned by him. It may have been that on demanding the aforesaid amount by husband of the applicant, deceased had taken this extreme step.

Learned counsel for the applicant submits that applicant is not involved in any manner in the alleged offence, that no case is made out for abetment of suicide and on this ground, anticipatory bail has been sought.

Learned Public Prosecutor for the State was also heard who has opposed the anticipatory bail application raising an objection pointing towards the suicide note of the deceased holding applicant responsible for his death.

There is substance in the submissions of learned counsel for the applicant.

On due consideration of the aforesaid submissions, mainly those advanced by counsel for the applicant, without commenting upon the merits of the case, this application for grant of anticipatory bail is allowed. It is directed that in the event of arrest, the applicant -€ÂÂ" Smt. Shweta Nagru shall be released on bail, subject to her furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty thousand only) with one surety of like amount to the satisfaction of the Arresting Officer, subject to abiding the conditions enumerated under Section 438 (2) of the Cr.P.C. and she shall give due assistance to the Investigating Officer in the matter. In the event of arrest, the applicant shall appear before the Investigating Officer on 21.09.2021 and on all other subsequent dates, as may be fixed by the Investigating Officer from time to time.

M.Cr.C. No.45240/2021 is allowed and stands disposed of.
