Judgment

The instant petition has been filed for grant of the following reliefs:
a) To issue the writ of mandamus or direction in nature thereof to the respondents to call back Annexure P1, to issue provisional roll number and the petitioner may be allowed to sit in phase three (final professional) to be held from 17.08.2020.
b) To quash and set aside the Annexure P1 as it being illegal, arbitrary, unjust and not justifiable in the eyes of law.
c) To issue writ of mandamus or direction in the nature thereof to direct the respondents Nos. 2 and 3 to allow petitioner to appear in Phase-3 (third professional) Part-1 as well as in all other subsequent/remaining examination required for completion of MBBS degree."
It is not in dispute that decision in such like matters is required to be taken by the Executive Council of the University.
Accordingly, we dispose of the instant petition with a direction to the petitioner to make a representation within two weeks from today and upon such representation being made within the stipulated time, the Executive Council of the University shall take a decision thereupon within a period of four weeks thereafter.
We are informed that the exams to the next semester are being held with effect from 01.04.2021. Therefore, in the given circumstances, we direct the University to provisionally permit the petitioner to sit in those examinations subject to the outcome of her representation. Pending application, if any, also stands disposed of.
