O R D E R
Mr. Lakshminarayan Krishnamoorthy, Interim Resolution Professional (IRP) appointed by this Bench is present in person. He has confirmed that the Petitioner/Operational Creditor is the only member of the Committee of Creditors (CoC) in this case and the claim of the Operational Creditorhas been settled by the Corporate Debtor in full through post-dated cheques which are in the process of clearance. The Operational Creditor has filed Form FA with 100% voting of the CoC where the Operational Creditor is the only member. IRP is also confirmed that his fee has also been paid in full.
Accordingly, IA-760/2020 in CP(IB)-2182(MB)/2019 filed by the IRP for withdrawal of CIRP is allowed.
IRP is directed to handover the charge of all the assets of the Company alongwith the books of accounts, etc. to the Corporate Debtor. CIRP initiated against the Corporate Debtor vide our order dated 25.10.2019 is hereby closed. All stakeholders may be informed accordingly. Corporate Debtor is free from the rigors of CIRP. IRP is fully discharged of his duties.
