This is first application filed by the applicant namely Shubham @ Monu Yadav under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail relating to FIR/Crime No.291/2026 registered at Police Station Rangnathnagar, District Katni (M.P.) for the offences punishable under Sections 8/21, 22 of NDPS Act and Section 5/13 of M.P. Drugs Control Act.
Learned counsel for the applicant vehemently submitted that the co-accused persons namely Anurag @ Dipu @ Ramjan Sen and Ganesh @ Manja Sen were released on regular bail vide order date 09.01.2026 passed in M.Cr.C.No.55716/2/2025 of this Court, which clearly reflects that the applicant has been falsely implicated in a fabricated case. Thus he prays for grant of anticipatory bail of the applicant.
Learned counsel for the respondent/State submits that the applicant is required for custodial interrogation, there is material evidence against him and one cannot claim for parity of anticipatory bail with the co-accused persons who have been enlarged on regular bail.
Considering the overall facts and circumstances of the case, no case is made out for anticipatory bail. However, applicant is directed to surrender before the trial Court and apply for regular bail.
Accordingly, this application is dismissed.
