Judgment
Shiv Narayan Dhingra, J.—It is submitted by SI Anupam that he had informed the respondents(parents of petitioner) about the date of hearing and the necessity of the respondents to appear in the Court today. However, respondents have not appeared. The petitioner is in need of her passport which has been kept back by her parents after calling her from USA. The passport is the property of the petitioner and she has a right to recover her passport, even if it is in custody of her parents, who are refusing to part with it
The police shall obtain necessary search warrants from the Court of concerned Metropolitan Magistrate and conduct search of the house of respondents and recover the passport of the petitioner from the respondents, in case respondents do not voluntarily return this passport to the petitioner within two days from today.
A copy of this order be given dasti to the counsel for State as well as to the petitioner. The concerned police official shall visit the house of respondents and ask them to hand over the passport voluntarily and in case it is not handed over voluntarily, then steps for search warrants should be taken. A compliance report be filed by the police within ten days from today. With above directions, the present petition stands disposed of.
