Judgment
Heard.
This petition has been brought seeking issuance of appropriate writ against the impugned order dated 12.4.2021 passed by respondent No.3 - Office of
Chief Medical and Health Officer.
It is submitted by counsel for the petitioner that the petitioner was an applicant seeking permission for opening COVID Centre in the petitioner's
hospital. The same was not considered, however, the application of respondent No.4 - Krishna Hospital has been allowed and also has been permitted
to use the premises of the hospital of the petitioner for running a COVID Centre, which is the violation of the right of the petitioner.
Learned State counsel appearing for respondents No.2 and 3 opposes the submissions and it is proposed that the application of the petitioner which is
pending can be considered by respondent No.3 in future and this petition may be disposed off.
Learned counsel for the petitioner has objection and submits that an appropriate order be passed or interim relief be granted to the petitioner.
After considering the submissions, it is ordered that the impugned order shall not be given effect to till the next date of hearing and no fresh patients be
admitted. Prior to this order, if any patients have been given admission in the petitioners hospital in that case the treatment of such patients shall
continue till their discharge.
Issue notice to Respondent - 4 on payment of process fee as per rules.
List this case after three weeks.
In the meanwhile, learned State counsel may also file reply, if he so wishes.
