Judgment
Petitioner has filed the present writ petition against the
order dated 29.08.2016, passed by the Additional District &
Sessions Judge No.2, Udaipur.
After arguing some time, Mr. Purohit, learned counsel for the
petitioner seeks permission to withdraw the present writ petitions
with liberty to challenge the order of the Collector (Stamps) dated
18.03.2015, determining the Stamp duly payable on the
agreement dated 23.10.1997.
Liberty as prayed for is granted. Petitioner shall be at liberty
to lay challenge to the order dated 18.03.2015, passed by the
Collector (Stamps) in accordance with law, by way of filing
revision petition under Section 65 of the Rajasthan Stamp Act,
1998.
Since the petitioner has been pursuing his remedies against
the order dated 18.03.2015 before the Trial Court as well as
before this Court, the revisional authority shall appropriately
consider the time spent, in pursuing these remedies.
With these observations these writ petitions are dismissed as
withdrawn.
