Judgment
ORAL ORDER
The Writ Petition is filed seeking following reliefs:
a)Issue a writ in the nature of Mandamus directing Respondent Nos. 2 and 3 to consider the Petitioner’s representations submitted on 03/06/2026 at Annexure-B and on 15.07.2026 at Annexure-C and on 15.07.2026 to the Respondent No.2 at Annexure-D respectively, in accordance with law;
b)Grant such other relief/s as this Hon’ble Court deems fit in the circumstances of the case.
Heard, Sri.Shubham F.Kusalapur, learned counsel appearing for the petitioner, Smt.Sunitha J.Sequeira, learned Addl. Government Advocate for respondents 1 and 2 and Sri.Sharanabasava, learned counsel appearing on behalf of Sri.Gangadhar.J.M, learned counsel for respondent No.3.
The short point on which Sri.Shubham, argued this matter is, though an order of transfer passed, transferring the petitioner from Ilkal to Amingad Pattan Panchayat on 29.05.2026, however, no order to relieve him from the duty has been passed till this date, despite several representations to the concerned officers requesting to relieve him to join the post to which he has been transferred. The transfer of Sri.Vishwanath – petitioner as a Second Division Assistant from Ilkal to Amingad Pattan Panchayat as a Second Division Assistant is to a vacant post.
In that view of the matter, the Writ Petition is allowed. Respondents 2 and 3 are directed to consider the representations dated 03.06.2026 at Annexure-B, 15.07.2026 at Annexures-C and D respectively, in accordance with the law and pass appropriate orders, relieving the petitioner from the earlier post from which he was transferred in terms of the transfer order dated 29.05.2026, enabling him to join the place of transfer, within a period of two weeks from today.
