Judgment
Dalip Singh, J.—Heard Learned Counsel for the parties & perused the impugned order. The learned Courts below have allowed the application filed under Order 22 Rule 10 for substitution and impleadment of the purchaser of the property after the decree was passed by the learned trial court for eviction in favour of the landlord who said the property after the passing of the decree for eviction on the ground of default.
I have perused the orders passed by the learned trial Court as well as learned Appellate Court and find that the Courts below have not committed any jurisdictional error and allowing the said application. The objection which the Learned Counsel for the petitioner seeks to raise may be relevant only cases where the decree has not been passed but cases where the transfer has taken place after the passing of the decree for eviction on stand of a different footing as in the present case as held by the Courts below.
The writ petition is accordingly dismissed summarily as no case for interfere in writ jurisdiction is made out.
