F.M. Reis, J.—Heard Shri A.V. Nigalye, the learned Counsel appearing for the petitioner and Shri Shivan Dessai, the learned Counsel appearing for respondent no.1. During the course of the hearing of the above petition, Shri Nigalye, the learned Counsel appearing for the petitioner has pointed out that the portion of the award impugned in the above petition is the refusal of total back wages, but only 60% of the back wages have been directed to be paid. The learned Counsel further points out that though he seeks leave to withdraw the above petition, nevertheless, it is his contention that the calculations effected by the respondent no.1 to pay the said back wages are not correct.

The computation of the said amount of back wages is not a matter which is under consideration before this Court nor it is part of the pleadings in the above petition filed by the petitioner. The said aspect would have to be dealt with independently in accordance with law. As the petitioner seeks to withdraw the above petition, the same stands dismissed as withdrawn.
