A.P. Lavande, J.—Heard Ms. Gawas, learned Counsel for the Petitioner.

Rule. By consent of learned Counsel for the parties, heard forthwith.

The only grievance made by the Petitioner in this petition who has been granted parole by Respondent No. 2 by order dated 16th December, 2010 is that the surety amount of Rs. 50,000/-fixed by Respondent No. 2 is highly excessive. According to the Petitioner, he is a student, who is undergoing sentence of imprisonment for life for the offence punishable u/s 302 of I.P.C. and he is not in a position to offer the surety amount of Rs. 50,000/-as ordered by Respondent No. 2. Learned Counsel for the Petitioner submits that the surety amount be decreased to Rs. 10,000/-.

Mr. Ferreira, learned Public Prosecutor appearing for the Respondents has no objection.

In view of the above, Respondent No. 3 is directed to release the Petitioner on parole in terms of order dated 16th December, 2010 upon furnishing the bond of Rs. 10,000/-instead of Rs. 50,000/- subject to compliance of rules.

Rule is made absolute accordingly.
