Judgment
By way of the present petition, the petitioners seek to challenge the impugned Memo No. 3/ADV/2012-15/9 dated 18th November, 2015
issued by Deputy Commissioner & Chairman, District Selection Committee, West Jaintia Hills, Jowai. The petitioners also seek direction to the
respondents to relax the age of the petitioners for participating in the selection process.
The respondents have contested the petition and an affidavit was filed on 26th February, 2016. Thereafter, an additional affidavit on behalf of
the respondent No. 2 was filed on 6th October, 2017.
Learned counsel for the respondents submits that an additional affidavit of Deputy Secretary to the Goverenment of Meghalaya, Forest &
Environment Department has been filed on 6th October, 2017. She also submits that the age of the petitioners have been condoned by the
Government of Meghalaya vide letter dated 23rd March, 2016. A copy of the said letter has been filed along with the additional affidavit dated 6th
October, 2017.
Mr. S.D. Upadhaya, learned counsel for the petitioners submits that in view of the additional affidavit filed on behalf of the respondent No. 2
dated 6th October, 2017 and letter dated 23rd March, 2016, the petitioners do not want to pursue the present petition. He also submits that an
application for withdrawal of the writ petition bearing MC(WPC) No. 196 of 2017 has been filed today.
Ms. P. Agarwal, learned counsel for the respondents submits that she has no objection to the prayer made by learned counsel for the
petitioners.
In view of the facts and circumstances of the case as well as the application bearing MC(WPC) No. 196 of 2017, the writ petition is dismissed
as withdrawn.
