PER AMITABH SHUKLA, AM

These appeals by the assessee are directed against the order of learned CIT(A), Delhi-26 dated 8th October, 2025 for the assessment year 2015-16, 2016-17, 2017-18 and 2019-20.

2.

At the time of hearing, learned Counsel for the assessee submitted that the ITAT, vide Order dated 17th October, 2025 in assessee's own case for the relevant assessment years, has deleted the quantum addition by quashing the assessment order. A copy of the said order was placed on record. It was, therefore, submitted that as a consequence, the penalties imposed under Section 271(1)(c) of the Income-tax Act, 1961 cannot stand.

3.

Learned CIT-DR agreed with the said submission.

4.

After considering the submissions of both the sides and perusing the material placed before us, we observe that the Tribunal, vide Order dated 17th October, 2025 in ITA No.3283/Del/2023 & Others, has quashed the assessment order and deleted the impugned addition involved in all these assessment years. We are of the view that since the underlying quantum addition has already been deleted by the Tribunal, the penalties imposed in these assessment years under Section 271(1)(c) do not stand, and are liable to be deleted. We order accordingly.

5.

In the result, all the four appeals of the assessee are allowed. Decision pronounced in the open Court on 25th February, 2026.
