Judgment
Gita Gopi, J
The relief is against the ‘No Fault Liability’ (NFL) order passed in Motor Accident Claims Petition No.137 of 2018.
The Insurance Company as well as the claimants shall have all the liberty to raise all the objections or grounds which have been raised herein in the petition before the learned Tribunal where the claim petition is pending. The learned Tribunal shall consider those objections or grounds raised at the time of final hearing of the matter. In the meantime, the amount be deposited before the learned Tribunal and the same be placed in the Fixed Deposit Receipt (FDR) till final disposal of the matter. This order will not adversely affect the plea of the claimants or the Insurance Company.
The learned Tribunal would decide the liability of the amount deposited in the FDR of the NFL amount at the final stage, till then the original FDR be kept in the custody of the Nazir.
Accordingly, the present appeal stands disposed of. Connected application/s, if any, also stand disposed of.
