The petitioner has filed the present petition, inter alia, seeking quashing the entry of Adverse/Advisory remarks of Part Performance Assessment

Report for the period from 15th November, 2014 to 31st March, 2015. The petitioner has also challenged order dated 9th June, 2016 and

impugned Signal A/7087 dated 21st August, 2016 as well as impugned communication dated 30th November, 2015.

The respondents have moved an application challenging the maintainability of the present petition before this Court, bearing Misc. Case No. 158

of 2017, on the ground that during the relevant period the petitioner was posted in Tripura, adverse remarks were recorded and communicated at

Tripura and the petitioner is posted in Tripura.

Mr. R. Jha, learned counsel for the petitioner submits that the petitioner does not want to pursue the present petition and seeks permission to

withdraw the present petition with liberty to file a fresh petition before the competent Court having the jurisdiction. He has also moved an

application for withdrawal of the present petition which is taken on record.

Mr. N. Mozika, learned counsel for the respondents has no objection to the prayer made by learned counsel for the petitioner.

In view of the facts and circumstances of the case and submissions made by learned counsel for the parties as well as the application for

withdrawal of the petition, the present petition is dismissed as withdrawn with the liberty aforesaid.

The writ petition and Misc. Case No. 158 of 2017 stand disposed of.
