The complaint is that the judgment dated 18.10.2010 in LPA No.145 of 2010 has not been complied with. The issue pertains to the appointment on compassionate ground. The respondents have passed Annexure R-1 order. It is stated in the order that there are 20 persons above the petitioner in the category of appointment on compassionate ground in Class-III post. According to the petitioner, in case of other persons, who have cause of action subsequent to the petitioner, appointments have been given.Be that as it may, in view of Annexure R-1 order, wherein it is stated that there are 20 persons above the petitioner, waiting in the queue for appointment on similar grounds, it cannot be said that there is any contumacious conduct on the part of the respondents. Therefore, the COPC is dismissed, making it clear that in case any person in the seniority list junior to the petitioner is appointed, petitioner shall also be appointed alongwith that person.
