Judgment
Justice Kurian Joseph, C.J.—The writ petition is filed mainly with the following prayer:
i. That the respondents may be ordered to integrate the services of the petitioners in the equivalent grades as per the terms and conditions of the take over with all the benefits incidental thereof like promotion and seniority etc.
According to the petitioners, the issue is covered by Annexure P-2, the judgment of this Court rendered in CWP No. 4491 of 2011-E, titled as Prem Pal Singh versus State of H.P. and other connected matters, decided on 23.11.2011, in the matter of integration of Nahan Foundary to the Government Departments. The writ petitions were disposed of vide Annexure P-2 with the following directions:
I) The workers of the Nahan Foundary will be deemed to have been integrated in the PWD/IPH department as on 1.10.1988.
II) The workers will be adjusted according to their interse seniority in the Nahan Foundary, below the workers in PWD/IPH department in the equivalent cadre/scale of pay as on 1.10.1988.
III) In case equivalent scale of pay is not available in PWD/IPH department, when workers of Nahan Foundary will be taken and integrated with the workers with the next available scale of pay.
IV) Thereafter, the further promotions will be governed by the seniority, as stipulated above.
It is made clear that any other award/order to the contrary will be ignored to the extent, as above. The needful action in this regard will be taken in the matter by the PWD/IPH department within a period of 4 months. The pending application(s), if any also stand disposed of.
In case the petitioners are also similarly situated, they shall be entitled to all the benefits in terms of the judgment, as extracted above.
The writ petition stands disposed of, so also the pending application(s), if any.
