Mr. S.P. Mahanta, learned Legal Aid Counsel appearing for the applicant has submitted that this instant application has been filed with a prayer for condonation of delay of 1661 days in filing the related appeal. On being convicted by the court of the learned Sessions Judge, West Jaintia Hills District, Jowai, in Sessions Case No. 105 of 2013 the applicant/appellant coming from a disadvantaged background could not approach this Court within the stipulated period. However, on being assigned legal aid counsel, the period for filing the related appeal has already lapsed, hence the delay. It is prayed that this application may be allowed, delay of 1661 days may be condoned.

Mr. R. Gurung, learned GA appears for the State respondent and has no objection to the prayer of the applicant.

We have considered the submission and on perusal of the pleadings made in this application, this Court is persuaded to allow the prayer made. The delay as stated is hereby condoned.

Accordingly, the delay of 1661 days in preferring the related appeal is hereby condoned.

Registry to diarize the appeal and list the same for admission after 1(one) week.

Misc. Case is disposed of.
