Judgment
Dev Darshan Sud, J.—The petitioner challenges the order passed by the learned Presiding Officer, Fast Track Court, Mandi dismissing his revision against the order dated 1.10.2009 passed by the learned Sub Divisional Judicial Magistrate Ist Class, Gohar, District Mandi, granting maintenance to the Respondent.
The learned appellate Court while adjudicating holds:
The petitioner has not come forward with the plea that he is ready to pay the arrears of maintenance amount and is ready to provide all the necessities of life to her and not to give beatings to her, if she reside in the alleged newly constructed house and he will join and reside with her in the newly constructed house.
The perusal of the order dated 1.10.2009 also shows that the order is an interlocutory order and the revision petition against this order is not maintainable and on this score also the revision petition is not maintainable against the order dated 1.10.2009.
For the foregoing reasons and discussions, the point in hand is decided against the petitioner and in favour of the Respondent.
There is no merit in this petition and in revisional jurisdiction this Court will not undertake a detailed examination of the facts more especially in interlocutory orders. This petition is dismissed.
