There is in-ordinate delay of 1498 days in filing this petition. Heard learned counsel for petitioner. Perused the application for condonation of delay and affidavit, wherein, it is stated that, Ex. Petition No. 132/2006 was filed before the Principal Senior Civil Judge, Ramanagar, and petitioner was arrayed as judgment debtor. The petitioner entered appearance and filed objections to the execution petition. Thereafter, he could not keep track of the proceedings. He came to know of transfer of execution petition to MACT at Kasargod after seeing the paper publication.

The petitioner is a judgment debtor in Ex. Petition No. 132/2006 and he was expected to keep track of the proceedings. The petitioner cannot plead ignorance about order of transfer of the case. Therefore, there are no grounds to condone the delay.

In the result, I pass the following:

ORDER

I.A.-1/2012 as also petition are dismissed. I.A.-2/2012 and I.A.-3/2012 do not survive for consideration.
