This is a petition under Section 482 of the Code of Criminal Procedure (Cr.P.C.) for quashing of proceeding of G.R. Case No. 172 of 2012

pending before learned Judicial Magistrate First Class, Nongpoh, Ri-Bhoi District.

Learned counsel for the petitioner submits that the petitioner was married with respondent No. 4 and they are living together. However, on

perusal of paragraphs 2, 3, 4 and 5 of the petition it is revealed that respondent No. 2 is wife of the petitioner.

At this stage, Mr. P.T. Sangma, learned counsel for the petitioner submits that there are typographical mistakes in the petition. He seeks

permission to withdraw the present petition with liberty to file a fresh petition. Learned counsel for the petitioner has moved an application seeking

permission to withdraw the present petition with liberty to file a fresh petition.

Mr. S. Sen Gupta, learned Addl. P.P. for respondents No. 1, 2 and 3 submits that he has no objection to the prayer made by learned counsel

for the petitioner.

Having considered the facts and circumstances of the case and submission made by learned counsel for the petitioner as well as the application

filed on behalf of the petitioner, the present petition is dismissed as withdrawn with the liberty as prayed.

Lower court case record be sent back immediately. CRL. M.C. No. 7 of 2017 In view of the above, Misc. Case stands disposed of.
