The petitioner, Shri Hmar Ramengmawia has moved an application Under Section-37 of the Narcotic Drugs and Psychotropic Substances Act,

1985 read with Section- 439 of the Code of Criminal of Procedure, 1973 (Cr.P.C.) seeking bail in connection with Mawlai P.S. Case No. 97

(11) of 2016 under Section 21 (a) (b)/27 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for petitioner submits that the petitioner was arrested on 07th November, 2016 and the petitioner is in custody for the last

more than four months.

During the course of arguments, Mr. R. Sharon, learned counsel for the petitioner submits that he may be permitted to withdraw the present

application with liberty to move fresh application before learned Special Judge, Shillong.

Learned counsel for petitioner has moved an application for withdrawal of the present application in this regard. Mr. R. Gurung, learned counsel

for respondents submits that he has no objection to the same.

In view of the facts and circumstances of the case and submission made by learned counsel for petitioner, the present application is dismissed as

withdrawn with the liberty aforesaid.
