In the present appeal the challenge is to the order dated 09.05.2022 passed by DRT-II, Chandigarh in O.A. No.3082/2017 titled as Punjab & Sind Bank V. National Sales Agency & others whereby appellants who were defendants no.4 and 5 were ordered to be proceeded ex parte and an application for condonation of delay was ordered to be dismissed. The order dated 09.05.2022 reads as under:

None is present on behalf of the defendant Nos. 4 and 5. So, they are proceeded against ex parte. Application for condonation of delay is also dismissed for default.

To come up on 26.08.2022 for ex parte arguments. A two page synopsis be filed at least a week before the next date of hearing.

The counsel for the appellants stated that the O.A. bearing no.3082/2017 has already been disposed. In the circumstance, the present appeal against a miscellaneous order does not require further adjudication. Accordingly the appeal is disposed of.

The counsel for the appellants stated that the appellants are senior citizens of more than 85 years of age and they are willing and ready to settle the dispute with the respondent Punjab & Sind Bank. The appellants being defendants 4 and 5 shall be at liberty to make sincere efforts for an amicable settlement with bank. Punjab & Sind Bank is also directed to make sincere efforts for an amicable settlement of the dispute taking into consideration the old age of the appellants.
