By way of the present revision petition under Section 397 of the Code of Criminal Procedure, 1973 the petitioner has challenged the impugned

judgment dated 24.05.2017 passed by learned Sessions Judge, Tura, whereby the petitioner has been convicted under Section 354 I.P.C. in

Session Case No. 38/2015.

On specific query put to the learned counsel for the petitioner regarding maintainability of the present revision petition, the learned counsel for

the petitioner submits that order of sentence was passed on 24th May, 2017 but due to inadvertance, the petitioner has not challenged the order of

the sentence and a copy of the impugned order of the sentence has not been filed along with the present petition.

At this stage, Mr. K.C. Gautam, learned counsel for the petitioner seeks permission to withdraw the present petition with the liberty to avail

appropriate legal remedy.

Mr. K. Khan, learned P.P. appearing on behalf of the respondents has no objection to the submission made by learned counsel for the

petitioner.

Considering the facts and circumstances of the case and the submission made by the learned counsel for the petitioner, the present revision

petition is dismissed as withdrawn with the liberty aforesaid.
