The petitioner, Shri Biswajit Dey impugned the selection and appointment of the respondents No. 5 and 6 as Vocational Instructor in the office

of the respondents. The petitioner has also impugned letter dated 24th January, 2012 and impugned order dated 23rd January, 2013 issued by the

Deputy Director of Training (WT), Government of India, New Delhi.

Respondents No. 1 to 4 have filed counter affidavit. Counter affidavit has also been filed by respondents No. 5 and 6.

During the pendency of the petition, the petitioner has filed amended petition dated 10.02.2017 along with application for amendment of the

petition. The application for amendment came up for hearing on 14.03.2017 and the petitioner sought adjournment and the matter was adjourned

to 21.03.2017.

The petitioner appears today and submits that the application for amendment is incomplete and he has filed an affidavit dated 17.03.2017. The

petitioner submits that he may be permitted to withdraw the present petition with liberty to file fresh petition after incorporating all the grounds.

Mr. R. Debnath, learned counsel for respondent No. 1 to 4 and Ms. S.A. Challam, learned counsel for respondents No. 5 and 6 have no

objection to the prayer made by the petitioner.

In view of the facts and circumstances of the case and submission made by the petitioner as well the affidavit dated 17.03.2017, the present

petition is dismissed as withdrawn with liberty as prayed.
