1.

The applicant has preferred this First Bail Application under Section 483 of the BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 151/2024, registered at Police Station Balrampur, District – Balrampur-Ramanujganj (C.G.) for offence punishable under Sections 137(2) and 64(2)(m) of BNS and Sections 4 and 6 of POCSO Act.

2.

As per the case of the prosecution, mother of the victim lodged a missing report on 01/10/2024 stating that her daughter went somewhere without informing her on 29/09/2024 and has not returned till date. Thereafter, victim was recovered on 01/12/2024 from the company of the applicant and thereafter, the aforestated offence was registered against the applicant.

3.

Mr. Rahul Dewangan, learned counsel for the applicant, would argue that on the date of the incident, there was a love affair between the applicant and the victim and both of them stayed at Bhatapara from 29/09/2024 till 01/10/2024 and established physical relations. He would further submit that the investigation has been completed and charge-sheet has already been filed and the applicant is in jail since 02/12/2024, thus, the appellant be released on bail as conclusion of trial is likely to take some time.

4.

On the other hand, Mr. Sourabh Sahu, learned counsel appearing for the non-applicant/State, would oppose the bail application and submit that at the time of the incident, the victim was a minor and therefore, the contention of consent of the victim would be irrelevant. He would further submit that serious allegations have been levelled against the applicant with regard to sexual assault of the minor victim and the victim has already been examined before the trial Court wherein she has supported the case of the prosecution, therefore, the applicant is not liable to be released on bail.

5.

In compliance of order dated 15/07/2026, victim’s father appeared before this Court through video conferencing from the concerned District Legal Services Authority (DLSA) and gave his consent for grant of bail to the applicant.

6.

I have heard learned counsel appearing for the parties and perused the case diary as well as the material available on record.

7.

Having considered the facts and circumstances of the case and serious nature of allegations levelled against the applicant, also considering that on the date of the incident, the age of the victim was 17 years and lastly considering the evidence of the victim, who has already been examined as PW-1 before learned trial Court, wherein she has stated that the present applicant took her to Bhatapara and sexually assaulted her on account of which she conceived and thereafter, she was recovered by the Police from the company of the applicant, I am not inclined to grant bail to the applicant.

8.

Accordingly, this bail application filed by the applicant – Shravan Yadav in connection with Crime No. 151/2024, registered at Police Station Balrampur, District – Balrampur-Ramanujganj (C.G.) for offence punishable under Sections 137(2) and 64(2)(m) of BNS and Sections 4 and 6 of POCSO Act is hereby rejected.
